GEICO: AUTO ACCIDENT CLAIMS AND SETTLEMENTS

GEICO is a big player in the auto insurance market in Maryland and throughout the country. GEICO provides auto insurance for over 7 million policyholders and insure over 12 million cars.  The company is owned by Warren Buffett’s famed Berkshire Hathaway . GEICO is the third largest private passenger auto insurer in the U.S.. The growth of GEICO in the last decade has been due to quality marketing and successful branding tactics including the GEICO Gecko, who debuted in 1999. In Maryland, GEICO has been particuarly effective, earning the highest market share of any insurance company.

In years past, GEICO rarely took case to trial because it offered a fair settlement value before a lawsuit was filed. At least that was our law firm’s experience. There has been a seismaic shift in the five years – their settlement offers are marketedly worse. Now, more than most insurance companies, GEICO does change their tune a good bit when lawsuit is filed. Why the difference? One big component is that GEICO changes claims adjusters after a lawsuit is filed. It is easier for GEICO to change its mind than for a single adjuster who put their feet in concrete to pull themselves out just because a lawsuit if filed. But we all love thinking the last guy who did the job did an awful job. So it is easier for the new litigation claims adjuster to reevaluate the case and value it more reasonably. It is the way of things. It is human nature. Our lawyers just wish they could make the post-suit offer presuit to at least give the client and opportunity to decide whether they will take GEICO’s best offer. Because, certainly, some personal injury accident clients reject post lawsuit settlement offers that they would have accepted had they been offered before suit was filed.

GEICO is not all bad. GEICO arguably has the best relationship with its own clients of any car insurance company out there (notable exception: uninsured motorist claims with GEICO). Customer satisfaction with GEICO runs high with its clients; GEICO has always done extremely well in American Customer Satisfaction surveys.
