Permanent Injuries in Auto Accidents
The value of any auto accident case obviously varies with the severity of the injuries. The main driving force of 95% of large personal injury cases involves claims for permanency. A permanent injury is a physical or even, although rarely, a mental injury that restricts the victim's job or his ability to pursue the happiness Thomas Jefferson famously envisoned all American should be able to pursue. Ppermanent injury is the single biggest value driver in a case. Suffering in the past, while certainly compensable, does not resonate with a jury the way an injury does that will last a lifetime. Accordingly, insurance adjusters (and even Colossus), defendant's auto accident lawyers, judges and juries in Maryland car and truck accident cases are going to place a higher value injuries that are expected to stay with you forever.
Our accident lawyers often use what is called a per diem recovery for permanent injuries. Under the per diem theory, our lawyers contend that noneconomic loss for the rest of your life can be quantified at a monetary value per hour, day or week. Then, using life tables, our lawyers calculate how much this will mean over the course of the plaintiff's life. If you ask for $2 an hour for 40 years, less than a cheapest coffee at Starbucks, that adds up to over $700,000 over a lifetime. While many juridictions do not allow this arguement in per diem arguments, Maryland does.
