Uninsured Motorist Release
THIS INDENTURE WITNESSETH that, in consideration of the sum of _________________________ Dollars ($________), receipt whereof is hereby acknowledged, for myself and for my heirs, personal representatives, and assigns, I do hereby release and forever discharge ______________________________________________ from any and all contractual obligations whatsoever under the coverage designated under Policy Number ___________________ issued to ____________________________ by ___________________ and arising our of bodily injury/property damage sustained by _____________________ due to an accident on or about the _______ day of _________, 199__.
_____________________________________________, hereinafter referred to as the Trustee further agrees in consideration of said payment by _____________ as Beneficiary to hold for the Beneficiary all rights, claims, and causes of action which the Trustee has or may have against any person or person, organization, association or corporation other than the Beneficiary because of bodily injury and/or property damage which is the subject of the claim made against the Beneficiary.
The Trustee agrees to take, through any representative designated by the Beneficiary, such action as may be necessary or appropriate to recover the damages suffered by the Trustee from any person or persons, organization, association, corporation or business entity other than the Beneficiary who may be legally liable therefor, such action to be taken in the name of the Trustee, the Beneficiary to pay all costs and expense in connection therewith. It is further agreed that any monies recovered by the Trustee as the result of judgment, settlement, or otherwise, will be held in trust by the Trustee and paid to the Beneficiary, provided, however, any sum recovered in excess of the total amount paid by the Beneficiary to the Trustee under the terms of the above-mentioned policy, shall be retained by the Trustee for his own use and benefit.
To procure payment of the said sum, I hereby declare: that I am more than eighteen (18) years of age; that no representations about the nature and extent of said injuries, disabilities, or damages made by any physician, attorney, or agent of any party hereby released, nor any representations regarding the nature and extent of legal liability or financial responsibility of any of the parties hereby released, have induced me to make this settlement; that in determining said sum there has been taken into consideration not only the ascertained injuries, disabilities, and damages, but also the possibility that the injuries sustained may be permanent and progressive and recovery therefrom uncertain and indefinite, so that consequences not now anticipated may result from the said accident.
I hereby agree that, as a further consideration and inducement for this compromise settlement, this settlement shall apply to all unknown and unanticipated injuries and damages resulting from said accident, casualty, or event, as well as to those now disclosed.
I understand that the parties hereby released admit no liability of any sort by reason of said accident and that said payment and settlement in compromise is made to terminate further controversy respecting all claims for damages that I have heretofore asserted or that I or my personal representative might hereafter assert because of the said accident.
